Nursing Home Abuse 
No One Really Knows...
No one knows precisely how many older Americans are being abused,
neglected, or exploited. According to the best available estimates,
between 1 and 2 million Americans age 65 or older have been injured, exploited,
or otherwise mistreated by someone on whom they depended for care or protection.
A congressional report has found that 5,283 — over 30 percent — of the nursing
homes in the U.S. were cited for an abuse violation that had to cause harm
between January 1999 and January 2001. Over 2,500 of the violations were serious
enough to cause actual harm or to place residents in immediate jeopardy of death
or serious injury.
Types of Elder Abuse
The National Center on Elder Abuse defines seven different types of elder abuse:
physical abuse; sexual abuse; emotional abuse; financial exploitation; neglect;
abandonment; and self neglect. These definitions are based on an analysis of
existing State and Federal definitions of elder abuse, neglect and exploitation
conducted by the Center.
Physical abuse:
Use of physical force that may result in bodily injury, physical pain, or
impairment.
Sexual Abuse:
Non-consensual sexual contact of any kind with an elderly person.
Emotional abuse:
Infliction of anguish, pain, or distress through verbal or non-verbal acts.
Financial/material exploitation: Illegal
or improper use of an elder's funds, property, or assets.
Neglect: Refusal, or failure, to fulfill any part of a person’s obligations or
duties to an elderly person.
According to the Nursing Home Reform Act of 1987, all residents in nursing homes
are entitled to receive quality care and live in an environment that improves or
maintains the quality of their physical and mental health. This entitlement
includes freedom from neglect, abuse, and misappropriation of funds. Neglect and
abuse are criminal acts whether they occur inside or outside a nursing home.
Residents do not surrender their rights to protection from criminal acts when
they enter a facility.
