Medical Malpractice
Shocking Statistics
A recent study by the Institute of Medicine of the National Academy of Sciences
estimated that as many as 98,000 patients may be killed each year in hospitals
alone as a result of medical errors and should be considered a national
epidemic. Earlier studies also found that this was a serious national
problem. Between 44,000 and 98,000 people die in hospitals annually each
year due to preventable medical errors, according to the Institute of Medicine
findings.
A RAND Corporation Study regarding health care quality by Mark A. Schuster,
M.D., Ph.D., Elizabeth A. McGlynn, Ph.D, and Robert H. Brook, M.D., Sc.D.
revealed that autopsy studies showed rates between 35% and 40% of missed
diagnoses resulting in death. Numerically, this is more than three
fully loaded jumbo jets crashing every week with no survivors. That number of
airplane crashes would mobilize many commissions, government investigations, and
a huge effort to prevent the crashes. Unfortunately, since medical malpractice
injuries happen separately and privately, the effect is not the same.
Even more disturbing, these numbers are only based on hospital
statistics. They do not include deaths from missed diagnoses or medical
negligence that occurred in clinics, private doctors' offices, or other
treatment facilities.
A 2006 follow-up to the 1999 Institute of Medicine of the National Academy of
Science study found that medication errors are among the most common medical
mistakes, harming at least 1.5 million people every year. According to
the study, 400,000 preventable drug-related injuries occur each year in
hospitals, 800,000 in long-term care settings, and roughly 530,000 among
Medicare recipients in outpatient clinics. The report stated that these
are likely to be conservative estimates.
At the same time, surprisingly few claims are filed. Only 2 percent of people
injured by physicians' negligence seek compensation through a lawsuit (according
to a 1991 article in the New England Journal of Medicine).

Picking Up The Pieces
You believe that you or your loved one has suffered as the result of medical
malpractice. Now what? How do you go about proving it and receiving
compensation for your suffering? You're hurting and you can't work.
The bills are piling up and it may seem as though there is no hope for you and
your family. What should you do?
-
Forget about evaluating the claim yourself, or trying to "work it out" with
the doctor or clinic or hospital. Usually, the "real" decision-maker is the
doctor's insurance carrier, and
the doctor's attorney. These people are not paid to help you, or to be candid
with you. They are paid to defeat your claim. You need an experienced
professional to help you evaluate your claim. Without an attorney, the doctor's
attorney and insurance company usually will not take you seriously. Just
proving that you have a claim generally takes the help of expert witnesses.
-
If you believe you have suffered medical malpractice, it is crucial that you
contact an experienced medical
malpractice attorney as quickly as possible. These cases are very different from other kinds of
personal injury cases such as
car accidents. Special rules and laws apply, and special tactics and strategies
are important. If your case has any merit at all, an experienced attorney
at The Law Offices of David P. Ginzberg is willing to sit down with you and explain all your options, without charge.
Then you can make a full and informed decision about whether or not you want to
go forward. The sooner you contact us, the better we can assess the
facts, develop a strategy and protect your rights. It costs you
nothing to call us and have a professional lawyer do an in-depth examination of your
situation and determine how much you deserve to be paid for your suffering. Don't wait, call
us today, toll-free: 1-800-611-0142 or send an e-mail
now.
-
Don't give up your rights! There are time periods within which you
must make your claim, or by law, you may be prevented from receiving the
compensation you
deserve. Lawsuits are complicated. You need an attorney
that is knowledgeable about medical malpractice law and can successfully fight for your
rights. You want an attorney who
will put your
concerns first and treat you with compassion and understanding, while
explaining exactly what's happening each step of the way.
-
If you have suffered medical malpractice, you are in no position to deal with an insurance company.
Insurance companies will want to settle with you as quickly and
cheaply as possible. Nothing personal... it's their job! How can
you be certain that you will be completely compensated for your loss?
If the medical malpractice resulted in injury or disability, how can you know the extent of your injuries today? In time, there may be
other symptoms or complications that emerge resulting in serious losses to your
well being. If you settle too soon or for too little, your chance of being
properly compensated for all of your injuries may be lost.
It's imperative that you retain an attorney to make certain that nothing has been
overlooked.
